Legal basis : Vaud notaries are subject to the Federal Law of September 25, 2020 on data protection (LPD), the Ordinance of August 31, 2022 on data protection (OPDo) and the Vaud Law of September 11, 2007 on personal data protection (LPrD/VD). The relationship between notaries and their clients is also covered by professional secrecy (art. 321 CP, art. 42 LNo/VD).

Data collected: we collect the usual contact and identification data required to draw up authentic instruments (identity, postal address, e-mail address, telephone number, date of birth, copy of identity card, marital status) for our customer file. Depending on the mandate and the documents to be drawn up, we may require additional data (e.g. AHV number, bank details). In principle, all data is collected directly from you, so that you will always know what data we hold. If, exceptionally, data is collected from third parties, we will inform you immediately.

Legal basis and purposes of processing: your data is processed on the basis of your consent (art. 31 al. 1 LPD), the performance and monitoring of the contract binding us to you (art. 31 al. 2 let. a LPD) and/or the fulfilment of a public task (art. 5 al. 1 let. b LPrD/VD). Your data will not be processed for any purposes other than those arising from the mandate you have given us.

Retention period: after the end of the mandate, your file is archived and kept, in principle, for a period of 10 years. The firm reserves the right to retain data for longer periods, in particular those relating to testamentary dispositions or litigation. At the end of the retention period, the firm has the right to destroy any file in its possession. This destruction relieves Etude of all responsibility.

Communication of data: we never communicate your data to third parties, except in cases where this is necessary for the execution of the mandate (e.g. filing a deed with an authority) and after informing you. In addition, our technical subcontractors (IT service providers, etc.) are all based in Switzerland or in a country with legislation ensuring an adequate level of protection according to the Federal Council (Germany). Subcontracting is carried out under our responsibility and in compliance with the purposes listed above.
